Thimerosal Lawsuit

High number of thimerosal lawsuits anticipated

“The CDC’s failure to state a preference for thimerosal-free vaccines in 2000 and again in 2001 was an abdication of their responsibility. As a result, many children received vaccines containing thimerosal when thimerosal-free alternatives were available.”

“Mercury in Medicine- Taking Unnecessary Risks”, a report prepared by the Staff of the Subcommittee on Human Rights and Wellness Committee on Government Reform United States House Representatives, May 2003

After an extensive three-year investigation initiated by the Committee on Government Reform, a report was released concluding that, “there’s no question that mercury does not belong in vaccines.” For the first time, U.S. officials have undoubtedly recognized that thimerosal poses a very serious risk to those subjected to its’ neurotoxicity.

The House of Representative report is likely to result in a large number of thimerosal lawsuits. For years, there have been a large number of concerns over the use of thimerosal-containing vaccines and the suspicious correlation to the rising number of autism cases. The thimerosal report notes that despite three separate occasions in the last 15 years that changes have been made to vaccine policies to reduce risk of serious adverse effects, these changes were greatly inadequate.

Millions of American children were exposed to levels of thimerosal through vaccines that exceeded federal guidelines. At the time these children were required to receive thimerosal-containing vaccines, what has been described as an explosive growth in autism spectrum disorders and neurological and behavioral disorders occurred as well. A growing number of parents, physicians, and scientific experts have attributed the rise in autism to the thimerosal vaccines.

Vaccine makers and various government agencies have continued to maintain that there is a lack of evidence showing a link between thimerosal-containing vaccines and autism, however the report believed this is due to the “lack of serious, effective inquiry by our health agencies.” The thimerosal report calls for the immediate withdrawal of the only two vaccines left in the U.S. market containing any trace of thimerosal. Many parents were surprised and angered to find out their children have been subjected to levels of mercury that may have a link to the onset of autism and other neurological and behavioral disorders. Although thimerosal lawsuits have existed for years, there are thousands of families that were never made aware of the mercury contained in the vaccines and so the three-year statue of limitation to file a claim in the National Vaccine Injury Compensation Program was never exercised.

The controversy involving thimerosal-containing vaccines and the link to autism and other side effects will only continue to grow as more families learn of the dangers and proposals that have been made in attempts to protect vaccine manufacturers are ruled on. If these thimerosal proposals are passed, there may be little or no chance for thimerosal victims to recover any damages. For years children have been subjected to high levels of mercury far surpassing acceptable levels outlined by the EPA. The Government report stated “The possible risk for harm from….high level exposure to thimerosal is not ‘theoretical’ but very real and documented in the medical literature.”

Notable findings as included in new Government report
May 2003

There were many findings and recommendations included in the thimerosal report after the three year investigation on pediatric vaccine safety. Following are a few of the report’s findings. Contact us for more information on thimerosal lawsuits and thimerosal side effects.

“Manufacturers of vaccines and thimerosal have never conducted adequate testing on the safety of thimerosal. The FDA has never required manufacturers to conduct adequate safety testing on thimerosal and ethylmercury compounds.”

“Studies and papers documenting the hypoallergenicity and toxicity of thimerosal have existed for decades.”

“Autism in the United States has grown at epidemic proportions during the last decade. By some estimates the number of autistic children in the United States is growing between 10 and 17 percent per year. The medical community has been unable to determine the underlying cause(s) of this explosive growth.”

“At the same time that the incidence of autism was growing, the number of childhood vaccines containing thimerosal was growing, increasing the amount of ethylmercury to which infants were exposed threefold.”

“A growing number of scientists and researchers believe that a relationship between the increase in neurodevelopmental disorders of autism, attention deficit hyperactive disorder, and speech or language delay, and the increased use of thimerosal in vaccines in plausible and deserves more scrutiny. In 2001, the Institute of Medicine determined that such a relationship is biologically plausible, but that not enough evidence exists to support or reject his hypothesis.”

“The actions taken by the HHS to remove thimerosal from vaccines in 1999 were not sufficiently aggressive. As a result, thimerosal remained in some vaccines for an additional two years.”“To date, studies conducted or funded by the CD that purportedly dispute any correlation between autism and vaccines injury have been of poor design, under-powered, and fatally flawed. The CDC’s rush to support and promote such research is reflective of a philosophical conflict in looking fairly at emerging theories and clinical data related to adverse reactions from vaccinations.”
